HMRC High Income Child Benefit Charge (HICBC): update

Collyer Bristow successfully represented Jason Wilkes after HMRC issued a backdated High Income Child Benefit Charge (HICBC) bill for payments he received in 2014.

HMRC is appealing. Whilst we are unable to take on further individual appeals about the high income child benefit charge, we are considering taking a group action at a later date, depending on the outcome of the appeal. Concerningly, the Government is proposing to pass retrospective legislation to reverse the outcome of the Wilkes case so that even if we win in the Court of Appeal, other taxpayers will be unable to use the decision in their own cases.
