In the real estate and construction sector, Adrian represents developers and contractors in claims involving delay and disruption and interim and final account disputes.

On the non-contentious side, he drafts and advises on main and sub-contracts, terms of retainer, collateral warranties, bonds and other industry documents.  He also deals with construction-related property claims including disputed land rights, JV issues, and breach of contracts.

Construction and real estate:

  • Acting for property investment company in JV dispute concerning the development and construction of a £100m site in Central London by Middle Eastern interests, involving issues relating to the interpretation of a highly complex sequence of profit sharing agreements and issues of good faith and fiduciary duty.
  • Acting for billionaire European heiress as trustee of charitable foundation in dispute with adjoining owner of £50m property in Belgravia seeking damages for remediation costs and consequential losses under claims in trespass, nuisance and party wall issues arising from ingress onto neighbouring land of mass concrete poured in the course of development works..
  • Acting for various group companies of national house builder in the pursuit of numerous claims for damages in connection with failure of purchasers to complete the purchase of luxury apartments in landmark blocks in Central London.
  • Acting for offshore trust in connection with acrimonious dispute with contractor relating to the construction of a block of luxury apartments in Mayfair, concerning claims for delay and disruption, and the recovery of liquidated damages.
  • Drafting and advising on numerous JCT construction contracts, professional terms of engagement, collateral warranties, parent company guarantees, and other documents, relating to residential, industrial and commercial developments in London and elsewhere in the UK.

Insurance

  • Advising international insurer on policy coverage dispute relating to insurance of litigation claim worth €26m involving dispute between international investment fund and collapsed EU bank concerning allegations of negligence and fraudulent misrepresentation over the marketing of collateralised debt obligations.
  • Advising insurer and insurance intermediary in relation to policy coverage issues arising from a structural collapse at a hotel at a widely known tourist attraction in Southern England resulting in multi-million repair costs and ancillary losses.
  • Acting for an international insurer on the complex ramifications of having granted stop loss and financial protection insurance cover to the proprietors and shareholders of a North American company and Caribbean agents operating a nationwide legal expenses indemnity scheme which was declared illegal by several regulators as being contrary to insurance legislation. Advised insurer in relation to making of cease and desist orders by the regulators against its insured, and as to the orderly handling of the run-off business.
  • Advising high net worth owner of ocean yacht on coverage issues arising from fire on yacht when moored in Middle Eastern marina, due to electrical fault. The fire spread to and damaged other craft in the marina, causing extensive losses, and attracted the attention of the public prosecutor. The matter involved English, Italian and UAE law.
  • Advising insurer in relation to complex coverage issues arising from the issue of a multi-million policy to cover potential losses arising from the structured investment in a portfolio of international litigation risks by a syndicate of investors through subscribing in an offshore share offering.
