Carly Russell is a Partner is our Private Wealth team.

Carly brings over 25 years’ experience advising on both contentious and non-contentious private wealth matters, UK domestic and international.

Carly advises individuals, families and fiduciaries in the administration and planning of substantial wealth and complex international affairs for the purposes of lifetime planning, succession, asset protection and tax, with the use of corporate vehicles and traditional trusts and wills. Formal governance issues will often arise as part of the advice Carly gives. Carly has run high value and cross-border probate and trust matters throughout her career.

She is able to address issues associated with the challenges people may experience in respect of mental capacity and vulnerability, with focus on Court of Protection and Deputyship matters, trusts for vulnerable persons and the preparation and use of Powers of Attorney.

Carly has a passion for working with individuals to achieve their intentions within the charitable and philanthropic sphere, and to work with charities in their continued management and structural development.

The uniqueness of Carly’s skillset has enabled her to develop a strong practice over the last 25 years in all aspects of UK and cross-border private client dispute resolution, using her strengths in the non-contentious side of her business to give her that edge.  The types of common claims she will work on are dependency (1975 Act) claims, TLATA claims, will challenges, trust breaches, claims by disappointed beneficiaries, Court of Protection matters, professional negligence, personal taxation challenges and charity management.  Her emphasis is to use dispute resolution, and only court as a last resort, to achieve a result as cost effectively and timely as possible.

The Private Wealth Disputes team works closely with colleagues advising on non-contentious aspects, offering specialised advice on all aspects of family wealth disputes, including mental capacity, elder abuse, HMRC and personal taxation, disputes with trustees, inheritance disputes and contesting wills.
