‘Vento bands’ for injury to feelings awards to increase

On 28 March 2022 the Presidents of the Employment Tribunals in England and Wales and Scotland announced that the bands for injury to feelings awards (commonly known as ‘Vento bands’) have been updated for claims presented on or after 6 April 2022.

Key information

For claims presented to the tribunal on or after 6 April 2022 the bands are set as follows: 1) lower band – £990 to £9,900 2) middle band – £9,900 to £29,600 and 3) upper band – £29,600 to £49,300.

The bands apply to awards made by the tribunals in discrimination claims. The lower band applies in ‘less serious’ cases, where the discriminatory act is isolated or a one-off and the impact on the claimant less severe. The top band applies in ‘the most serious cases’, where for example there has been a campaign of discriminatory harassment. The middle band applies in cases that are serious, but which do not merit an award in the top band. In exceptional cases, an individual may be awarded a sum exceeding the top band.

In determining the level of any award the tribunal will consider the effect of the discrimination on the particular claimant, taking into account factors such as their vulnerability, the distress caused and the seriousness of the acts complained of, amongst other things.
